These Terms of use are in place in order to regulate the connection between M4 projekt, družba za investicije d.o.o. Brdnikova ulica 44, 1000 Ljubljana ID:54153115 (for future reference: M4 projekt) and the website user. Any and all valid regulations of Republic of Slovenia law will be in place during any interaction between the two mentioned subjects.
1.2
By accepting the offer (for future reference: Offer), user accepts all mandatory guidance regulated by these Terms of use. Before the offer is being accepted, M4 projekt will present these Terms of use to the user via website www.mialma.com.hr.
2.1
User will not in any way:
Use the websites against the website regulations
Use the websites to add or promote any content against website regulations including any and all damaging, threatening, blatant, offensive content, content that insult or discriminate in any way
Change, delete or destroy any of the website data
Use the website to violate the rights of third parties including any secrecy agreements, intellectual property violations
Use the website to send e-mail messages that are not regulated via Terms of use
Add, promote or distribute any illegal software like computer viruses, spyware, malware and trojan files, etc.
2.2
All data available on the website may not be reproduced, distributed and used in any commercial way without a strict permission from M4 projekt. Same data may not be used to damage the rights of any third parties. Data available on the website may be used exclusively for individual user usage and only by following the rules and regulations that protect any legal rights of users and third parties.
2.3
By using the website User accepts all the risks of the website usage, and may use the website data only for personal goals, on its own responsibility.
2.4
M4 projekt will not accept any responsibility for situations that may occur or are connected to the website usage, or to any actions and results regarding user using the website content in good or fair will.
2.5
Web sites use files, data, information and links to other websites created by third parties which will be properly described to the fairest range possible. M4 projekt has no control over third party websites and is completely recused from all responsibility for user usage of those websites. Third party website owners are not connected to M4 projekt in any way apart from the website links.
2.6
M4 projekt has the rights to change website content, discontinue website, limit access with no prior notifications and cannot be held accountable for any after effects that came as results to such actions.
2.7
M4 projekt cannot be held accountable for any after effects that came as a result of website unsearchableness or any other technical issues.
2.8
M4 projekt has the right to change the pricelist of its products and services. All valid prices are being displayed in the official M4 projekt pricelist visible on the website.
2.9
M4 projekt has the right to restrict access to certain IP addresses (Users) that are pursuing actions that violate any of the Terms of use, and will not be held accountable for it.
2.10
M4 projekt is not being held accountable for any costs that are a result of Users usage of computer equipment and telecommunications systems needed to access the website and web shop.
3.1 All prices listen on the www.mialma.com.hr website and M4 projekt business catalogues are displayed in Euro (EUR), unless specifically otherwise designated.
3.2
Products and services offered by M4 projekt can be paid via:
Credit cards that are displayed in online shop of M4 projekt, via PayPal and “Cash od delivery”.
3.3
All credit card payments are being secured by Braintree online Payment system. In such case nor M4 projekt not Braintree have access to your credit card number. Those information are available exclusively to credit card issuer, credit card owner (Braintree system uses the most modern standards when it comes to protecting the privacy of your data – Secure Socket Layer (SSL) protocol with 128-bit data encryption and the MD5 algorithm. ISO 8583 protocol is in place in order to secure the data exchange between Braintree and credit card authorisation centres take place on a private network that is secured by a double firewall.
4.1
All complaints regarding delivered goods are valid within 14 days of the delivery date. Complaint is considered valid if the ordered goods don’t match the goods ordered, if the product is of poor quality, damaged or not delivered in the designated timeframe. 4.2
Complaints must be presented in written form (post letter or e-mail message) according to the article 10, part of the User protection law. M4 projekt will address the issue and respond to the complaint within 15 days.
5.1
All services and products may be ordered 24/7. All orders are being processed Monday to Friday 08-20h, Saturday 09-17h. User must fill in the form with data needed to place the order and confirm the purchase and will be notified via e-mail upon placing a successful order. M4 projekt will deliver only confirmed orders. Goods are being selected from the image gallery of a certain product category. Purchase the goods by clicking on ‘’Add to basket” where a basket with item delivery will be presented to you. By selecting delivery the delivery price will be added to the initial item price. Next step is pursuing the presented link and filling out a form, whether you are buying as an individual or as a company. You will receive an e-mail notification regarding your order shortly after the purchase has been made.
5.2
The order will be regarded as valid only if all needed data has been correctly placed, they confirm to the terms of sale and the payment has been successfully processed.
5.3
If the User who ordered the item wants to send a message with the item ordered, the recipient must know the senders information. Those messages must not contain any blatant, inappropriate, discriminating or other vile content. M4 projekt has the right not to reply a message with such content.
5.4
M4 projekt is obliged to deliver all ordered items that are in stock and conform to the delivery regulations. If M4 projekt is unable to process any of the ordered items the User will be notified via telephone or an e-mail message in order to either replace the item with another one or regarding the refund.
6.1
M4 projekt performs product delivery exclusively via delivery service. Delivery may take place in Croatia, Slovenia or worldwide.
6.2
Ordered item will be packed accordingly to avoid any damages during the transport. Delivery costs are not included in item price, and are presented and added during the ordering process.
6.3
Items are being delivered to a specified address to the person it is intended for or to any other person that will receive the delivery at the specified address. All delivered good come with a delivery note that must be signed in order to approve the delivery itself.
6.5
All deliveries will take place in a time that suits the User, and all purchases made prior to 24h will be sent to delivery the next day at earliest.
6.6
Items are being delivered only in the mentioned working hours, in the timeframe that bests suits the User who will be notified prior to actual delivery moment.
6.7
In case the recipient is not available on the address specified he/she will be contacted and a delivery note will be placed with contact data.
7.1
By accepting general Terms of use, the User grants M4 projekt the right to use and edit its personal information that includes OIB for its own purposes.
7.2
By providing a designation on a tick box, the User permits the actions of gathering, using, editing its personal information for the website purposes, including (and not only) the following:

7.3
M4 projekt will accumulate, edit and harbour personal and identification information regarding its Users. M4 projekt will keep the data in complete secrecy and use it solely for its own purposes according to the law and Terms of use.

M4 projekt has the right to inform the User about new products and services via promotional campaigns, solely if User agrees for such actions to take place. User may revoke its agreeing to such actions by sending the request in written form via e-mail message.
7.5
M4 projekt will hold and use personal information solely for the purposes clarified in Terms of use. Those data will be deleted, or made anonymous after the Terms of use are no longer in place.
7.6
M4 projekt will not publicly display any personal information that belong to third parties.
7.7
M4 projekt will take measures in order to keep your personal information safe (administrative, technical and physical protection that will not allow unauthorised access, copy or migration of data), and only authorised staff members will have access to such.
7.8
M4 projekt will allow Users to access their personal information in order to keep them updated, correct and complete.
7.9
In case of any inquiries regarding the personal information use, the User may contact M4 projekt directly at any time.
7.10
In case Users request their personal information being deleted, M4 projekt will do so, but sill possibly restrict those Users certain content on its websites.
7.11
User is obliged to provide only complete, correct and updated personal information.
8.1
These Terms of use will be displayed on M4 projekt websites. M4 projekt must display Terms of use to any Users during their first purchase. For and other purchases, it is being considered that the User already agreed and understand the Terms of use. M4 projekt has the right to change the Terms of use without prior notifications. All registered website Users must check Terms of use periodically in order to stay updates with all valid regulations.
8.2
All disputes between M4 projekt and Users considering Terms of use will first be handled in a friendly manor. If such action fails, the Court of Ljubljana will take place in handling the dispute.
8.3
These Terms of use are considered valid starting with 01.05.2020.
