TERMS AND CONDITIONS
Article 1. General Provisions
1.1.
These Terms and Conditions govern the rights and obligations between Jasmina Draganić s.p., Registration No. 9810897000, with its registered office at Skubičeva ulica 10, Vnanje Gorice, 1351 Brezovica pri Ljubljani, Slovenia (hereinafter referred to as the “Seller”) and the users of the website and purchasers of products and services (hereinafter referred to as the “Customer”).
1.2.
Any matters not expressly governed by these Terms and Conditions shall be subject to the applicable laws of the Republic of Slovenia and the mandatory consumer protection legislation of the European Union, where applicable.
1.3.
By placing an order through the website, the Customer confirms that they have read, understood and accepted these Terms and Conditions before concluding the purchase agreement. These Terms and Conditions are available at www.mialma.com.hr.
Article 2. Use of the Website
2.1.
The Customer agrees to use the website in accordance with applicable laws and shall not:
- use the website for unlawful purposes;
- upload or distribute unlawful, offensive, discriminatory, violent or pornographic content;
- modify or destroy website data without authorization;
- infringe the intellectual property rights of third parties;
- introduce viruses, malware or any other harmful software.
2.2.
All content published on this website is intended solely for personal and non-commercial use. Any reproduction, distribution or commercial use without the Seller’s prior written consent is prohibited.
2.3.
The Customer is responsible for their use of the website and any damage resulting from their actions.
2.4.
The Seller shall not be liable for damages arising from improper use of the website or the actions of third parties.
2.5.
The website may contain links to third-party websites. The Seller is not responsible for their content, availability or privacy practices.
2.6.
The Seller reserves the right to modify, supplement or remove website content at any time without prior notice.
2.7.
The Seller shall not be liable for temporary or permanent unavailability of the website caused by technical or other reasons.
2.8.
The Seller reserves the right to change product prices at any time. The price applicable to the Customer shall be the one displayed at the time the order is confirmed.
Article 3. Prices and Payment
3.1.
All prices are stated in Euros (EUR). The Seller is not registered for VAT; therefore, VAT is not charged in accordance with applicable legislation.
3.2.
Orders may be paid by:
- Visa, Mastercard and Maestro credit or debit cards;
- Cash on Delivery (where available).
3.3.
Card payments are processed through a secure payment system. The Seller does not have access to or store payment card information.
3.4. Gift Cards
Digital gift cards are available in predefined amounts and are delivered electronically.
Gift cards may only be used to purchase products from the Mi Alma online store, cannot be exchanged for cash, and are valid for 12 months from the date of issue.
Article 4. Complaints
4.1.
The Customer may submit a complaint in accordance with applicable law if:
- the delivered product does not match the order;
- the product has a material defect;
- the product was damaged during delivery;
- the product was not delivered within the agreed timeframe.
4.2.

4.3.
The Seller will acknowledge receipt of the complaint and respond within the legally prescribed period.
4.4.
If the complaint is justified, the Customer will be offered a repair, replacement or refund, depending on the circumstances and applicable law.
Article 5. Ordering
5.1.
Products may be ordered through the online store at www.mialma.com.hr.
5.2.
The Customer is responsible for providing accurate and complete information required to process the order.
5.3.
After an order has been placed, the Customer will receive an order confirmation by email.
5.4.
If a product is unavailable, the Seller will notify the Customer and offer either a replacement product or a refund.
Article 6. Shipping and Delivery
6.1.
The Seller delivers products to Croatia, Slovenia, European Union member states and other countries where shipping is available.
6.2.
All products are carefully packaged to ensure protection during transport.
6.3.
Processing and delivery times depend on product availability, the destination country and the selected shipping provider. The Customer will receive order status updates by email.
Article 7. Failure to Collect a Shipment
7.1.
The Customer is obliged to accept delivery of the ordered shipment.
7.2.
If the Customer unjustifiably refuses or fails to collect the shipment, the Seller reserves the right to recover the actual shipping and return costs.
7.3.
The Seller may refuse future orders or require advance payment from Customers who have previously failed to collect ordered shipments without justification.
Article 8. Personal Data
8.1.
The Seller processes the Customer’s personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), the laws of the Republic of Slovenia and the Privacy Policy published on the website.
8.2.
The Customer confirms that all personal data provided is accurate, complete and up to date and agrees to its processing for the purposes described in these Terms and Conditions and the Privacy Policy.
8.3.
The Seller may collect and process the following personal data:
- full name;
- billing and shipping address;
- email address;
- phone number;
- payment information required to complete the purchase;
- order information and customer communications;
- information provided for newsletters and other marketing activities where the Customer has given the appropriate consent.
8.4.
Personal data is processed for the following purposes:
- processing and fulfilling orders;
- delivering products;
- communicating with Customers;
- providing customer support;
- improving the quality of our services;
- sending transactional communications related to an order, including order confirmations, shipping updates and, where a Customer does not complete a purchase, abandoned cart reminders via email and/or SMS;
- sending newsletters and other marketing communications only where the Customer has provided prior consent.
8.5.
Personal data may be shared with third parties only where necessary to perform the contract or provide services, including shipping providers, payment service providers, communication automation providers and other contracted data processors acting on behalf of the Seller.
8.6.
The Seller implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration or misuse. Personal data is retained only for as long as necessary to fulfil the purposes for which it was collected or as required by applicable law.
8.7.
The Customer has the right to request access to, correction, deletion, restriction of processing, portability of, or object to the processing of their personal data in accordance with applicable law. The Customer may also withdraw consent for marketing communications at any time.

Article 9. Final Provisions
9.1.
These Terms and Conditions are published on www.mialma.com.hr and become effective on the date of publication. The Seller reserves the right to amend these Terms and Conditions at any time. Any amendments shall not affect purchase agreements concluded before such amendments entered into force.
9.2.
The Seller and the Customer shall make every effort to resolve any disputes amicably. If this is not possible, disputes shall be resolved before the competent court in accordance with the applicable laws of the Republic of Slovenia and the mandatory consumer protection legislation.
